Last week Blue Cross of Idaho filed the first "state-based" health plans, products that disregard a number of the Affordable Care Act's requirements for coverage offered on the individual market. While Idaho's recent guidance permits the sale of such products, the "Freedom Blue" plans are a clear violation of federal law. With an administration that has consistently spoken out against the ACA and a new Secretary of Health and Human Services, will the federal government intervene?
