A Perfect Storm: New Federal Rules on Health Reimbursement Arrangements Exacerbate Dangers of Unregulated Products
Beginning in 2020, new Trump administration rules will allow employers to offer health reimbursement arrangements (HRA) in lieu of traditional group health insurance and comply with the Affordable Care Act’s (ACA) employer mandate, leaving employees to fend for themselves on the individual market. Because of an obscure provision of the tax code, many employees will be required to shop for a plan outside of the ACA’s marketplaces, and face the aggressive marketing of products that do not have to comply with the ACA’s requirements that have also expanded under recent Trump administration rules. With the new HRA rule estimated to shift 6.9 million people off of traditional group insurance over the next decade, sending masses of employees to shop for off-marketplace plans creates the perfect storm for consumers to unknowingly enroll in inadequate coverage.
